Welcome to APIForge. By accessing or using our API generation and deployment platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
2. Description of Service
APIForge provides an AI-powered platform that enables users to:
- Generate API specifications from natural language descriptions
- Automatically create production-ready backend code
- Deploy APIs with isolated databases and authentication
- Monitor and manage deployed APIs through our dashboard
- Access analytics, logs, and observability features
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.2 Account Termination
We may suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
4. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Generate or deploy APIs for illegal activities or purposes
- Distribute malware, viruses, or harmful code
- Engage in unauthorized data collection or scraping
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers
- Circumvent rate limits or usage restrictions
- Impersonate others or misrepresent your affiliation
- Send spam or unsolicited communications through deployed APIs
- Store or process sensitive personal data without proper safeguards
5. Intellectual Property
5.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by APIForge and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 Your Content
You retain ownership of any content you submit, including API descriptions and generated code. By using the Service, you grant us a license to:
- Process your content to provide the Service
- Store your content on our servers
- Use anonymized data to improve our AI models and services
5.3 Generated Code
Code generated by APIForge for your projects is owned by you. You may use, modify, and distribute this code without restriction, subject to any third-party licenses that may apply to underlying frameworks or libraries.
6. Pricing and Payment
6.1 Subscription Plans
We offer various subscription plans with different features and usage limits. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice.
6.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorize us to charge your payment method for all fees incurred.
6.3 Refunds
Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion in cases of service issues or billing errors.
7. Service Level and Availability
We strive to provide reliable service but do not guarantee:
- 100% uptime or availability
- That the Service will be error-free or uninterrupted
- That generated code will be free of bugs or security vulnerabilities
- Specific performance metrics or response times
We will make commercially reasonable efforts to maintain service availability and provide advance notice of scheduled maintenance.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APIFORGE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from your use or inability to use the Service
- Unauthorized access to or alteration of your data
- Third-party conduct or content on the Service
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.
10. Indemnification
You agree to indemnify, defend, and hold harmless APIForge and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create or deploy through the Service.
11. API Usage and Rate Limits
Your usage of the Service is subject to the limits specified in your subscription plan:
- API request limits are enforced per billing period
- Rate limits are applied per minute/second as specified
- Exceeding limits may result in throttling or additional charges
- Abuse of the Service may result in account suspension
12. Data Security and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or by email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
14. Governing Law and Disputes
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- Binding arbitration in San Francisco, California
- Courts of competent jurisdiction in San Francisco County for injunctive relief
15. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and APIForge.
- Severability: If any provision is found invalid, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our consent.
- Force Majeure: We are not liable for failures due to circumstances beyond our control.
